We inform you that by accessing and using our website you are bound by and agree to the following terms and conditions. We reserve the right to change these terms and conditions as we see fit, your continued use of our site signifies your agreement.

This website is owned and operated by Arctophilia Designs. These terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors an optional membership, information of fairs and shows, information on teddy bear making courses, and also use of our online store to make purchases. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these terms.

In order to use our website and/or receive our services, you need to be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any applicable law or regulation applicable to you.

 

Right to Suspend or Cancel User Account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these terms or any applicable law or regulations.

Commercial Terms

When buying an item, you agree that:

(i) you are responsible for reading the full item listing before making a commitment to buy it:

(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.” 

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

You are responsible for any import duty or taxes your country charges on purchases you make.

Secure Shopping

When you shop and pay by credit or debit card our payment page is on a SSL secure server, which means that your credit card details cannot be intercepted while they are being sent from your computer to our server, your card details are then encrypted before being stored on our server.

Change of Mind

You have the right to cancel your order, change your mind. Time is of the essence you can only cancel by contacting us via our website contacts form for security reasons. You must quote your full account name, full address, telephone number and order number. If your cancellation is too late and your order has been packed and shipped you will only receive a refund on the value of the products when they are returned. You pay the delivery cost and return postage costs.

Payments

We accept payment by all major credit or debit cards through PayPal. Goods are only shipped once we are in receipt of your full payment.

Ordering & Shipping Costs

We try to be as reasonable as possible. We also try to send your package as quickly and securely as possible. Well wishin the legal consumer 28days. Please understand our shipping costs have to include staff handling, packaging and our transportation costs. We always use secure tracked shipping service either Royal Mail or Evri. You always have a choice of shipping options, by clicking the shipping drop down box you will see all choices. For heavy purchases Hermes will be cheaper but take a little longer to arrive.

International Shipping If Available

If buying from outside the UK your cart will not process an order over 2KG, please contact us by email to arrange shipping in separate orders. We will try to find you the cheapest options.

Delivery

Our delivery prices may be updated from time to time on the website.

We deal with all online transactions personally and will always choose and pack your parcels with care. Everything listed is in stock and we aim to process your order within 2 business days. Charges for post, insurance and packing are shown in the shopping cart. The delivery times stated by a courier services are only an estimate, these delivery estimates are only valid from when a parcel leaves our premises into the couriers care. After shipping we are not responsible for how long your parcel takes to reach you or for any unexpected courier delays. Bear in mind during busy holiday periods such as easter or Christmas your mail may be delayed.

When visiting external links or APS you must refer to that external websites terms and conditions of use.

Returns Policy

If you are not completely satisfied with your purchase, please contact us within 48 hours after you receive the goods to arrange to return them and receive a full refund of the item cost. The goods must be returned within 14 days of receiving them.

If the return is due to an error on our part or the goods were faulty or broken, we will of course credit your payment with the full purchase price and delivery cost of the goods.

However if you are returning the goods for any other reason, you will have to pay for the full return postage via Royal Mail recorded delivery, this gives you proof of return, and we will then refund the original payment for the goods cost only.

Please contact us via email with your full details and product information before returning the product back to us, so we can advise you on how to return the goods safely. Full refunds are only possible if the goods are returned back to us safely, and in an unused condition.

Paper Patterns are non refundable or returnable due to the risk of copyright theft.

Products can only be returned within the country they were originally purchased. 

These conditions do not affect your statutory rights as a UK consumer.

Our Right To Change Offering

We may, without prior notice, change or alter products, features, listing pages, text or photographs, or change any services; or stop providing services or any features of the services, or create limits for the services we offer on our website. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Our Right To Cancel Orders

We may permanently or temporarily cancel any website order without notice and liability for any reason. Your payment will however be fully reimbursed.

Right to Suspend or Cancel Teddy Bear Course Bookings

We may because of any unforeseen circumstances have the right at any time to permanently or temporarily cancel or suspend any teddy bear course bookings without notice and liability for any reason. We will not be made liable for anything other than your original course booking fee. In such circumstances only if there are possible future dates free they will be made available to you. If not we will fully refund your paid booking fee. Your booking can also be cancelled if in our sole determination your booking violates any provision of our terms or any applicable law or regulations.

Teddy Bear Course Bookings

You will only pay a small booking fee if you book online, you can pay the remaining balance on the day of your teddy bear course. Your booking fee secures your seat on any given course, it also covers our administration and material fees. Once your seat is reserved it can no longer be purchased by anyone else, hence this booking fee becomes non refundable after 28 days. To reiterate you are granted a period of 28 days from your initial payment to cancel any booking, after 28 days your booking fee is NON - REFUNDABLE. If in the future you need to cancel or change your chosen course date for any reason you then have the option of transferring to another course, this is only if your cancellation is in writing and more than 14 days prior to your chosen course date.  If you cancel less than 14 days prior to the course date the full course balance fee becomes payable. We will however upon receipt of your full payment, post a course kit with full instructions. Covid -19 Update to Booking Fee policy - All payments after the 28 day cancellation period remain non refundable. We will now honour all pre covid-19 course bookings  - Making them full transferable as full or partial payment towards any future course dates only. Please do not book if you do not agree with these terms.

Warranties & Responsibility

Every item we sell in hand packed and checked before leaving our premises. If we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.

Digital Colour Representations

Although we try our very best to show true colour representations of all our products, the goods you recieve may vary in shade from their pictures. The images and descriptions of the products and any packaging on our website or printed material are for illustrative purposes only. We cannot guarantee that a device's display of the colours or the printing of printed material accurately reflects the colour of the products. Your product may vary from those images.

Ownership of Intellectual Property, Copyrights and Logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music patterns, kits and all 'Intellectual Property Rights' related thereto, are the exclusive property of Arctophilia Designs. We have unfortunately had to suspend the Arctophilia Design Awards. Again in the future we may host these awards in good will, we do our best to provide a fair system and clear information. We endeavour to provide a good experience and a professional form of promotion for anyone entering... When entering the Awards you confirm agreement to the rules and permissions asked for. We and the Awards judges remain exempt from any claims or accusations made against them therefore you enter at your own risk. Please do not enter unless you agree to all our well laid out  terms and conditions.
